A JOINT RESOLUTION
|
|
|
proposing a constitutional amendment to prevent certain public |
|
|
officers and entities from prohibiting the operation of industries |
|
|
or other categories of business or commercial activity in this |
|
|
state. |
|
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article I, Texas Constitution, is amended by |
|
|
adding Section 35 to read as follows: |
|
|
Sec. 35. An agency or officer of the executive department of |
|
|
this state, a political subdivision of this state, or an officer of |
|
|
a political subdivision of this state may not prohibit the |
|
|
operation of an industry or other category of business or |
|
|
commercial activity otherwise legally operating in this state. |
|
|
SECTION 2. This proposed constitutional amendment shall be |
|
|
submitted to the voters at an election to be held November 2, 2021. |
|
|
The ballot shall be printed to permit voting for or against the |
|
|
proposition: "The constitutional amendment to prevent an agency or |
|
|
officer of the executive department of this state, a political |
|
|
subdivision of this state, or an officer of a political subdivision |
|
|
of this state from prohibiting the operation of a legally operating |
|
|
industry or other category of business or commercial activity in |
|
|
this state." |
