A JOINT RESOLUTION
|
|
|
proposing a constitutional amendment authorizing the denial of bail |
|
|
to certain persons arrested for evading arrest or detention. |
|
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Article I, Texas Constitution, is amended by |
|
|
adding Section 11d to read as follows: |
|
|
Sec. 11d. A person taken into custody for the offense of |
|
|
evading arrest or detention may be denied release on bail pending |
|
|
trial if a judge or magistrate, following a hearing, determines by a |
|
|
preponderance of the evidence that the person has been charged with |
|
|
evading arrest at least two times within a thirty day period. |
|
|
SECTION 2. This proposed constitutional amendment shall be |
|
|
submitted to the voters at an election to be held November 2, 2021. |
|
|
The ballot shall be printed to provide for voting for or against the |
|
|
proposition: "The constitutional amendment authorizing the denial |
|
|
of bail to persons arrested for evading arrest or detention." |
