A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a report by a school authority of a communicable disease |
|
|
during a declared state of disaster. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 81, Health and Safety |
|
|
Code, is amended by adding Section 81.0425 to read as follows: |
|
|
Sec. 81.0425. SCHOOL AUTHORITY REPORT DURING DECLARED |
|
|
DISASTER. A school authority shall report to the department and the |
|
|
Texas Education Agency if a child attending school or an employee or |
|
|
volunteer at the school provides notice to the authority that the |
|
|
individual is infected with a communicable disease for which the |
|
|
governor has declared a state of disaster under Section 418.014, |
|
|
Government Code. |
|
|
SECTION 2. Section 81.0425, Health and Safety Code, as |
|
|
added by this Act, applies only to notice provided to a school |
|
|
authority on or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2021. |
