A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to disclosure to legislators of certain attorney grievance |
|
|
information. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 81.0885, Government Code, is amended by |
|
|
amending Subsection (a) and adding Subsection (c) to read as |
|
|
follows: |
|
|
(a) All types of information, proceedings, hearing |
|
|
transcripts, and statements presented to the ombudsman are |
|
|
confidential and may not be disclosed to any person other than the |
|
|
chief disciplinary counsel unless: |
|
|
(1) disclosure is ordered by a court; or |
|
|
(2) a member of the legislature requests disclosure |
|
|
and the complainant consents to disclosure. |
|
|
(c) A member of the legislature to whom information, |
|
|
proceedings, hearing transcripts, or statements presented to the |
|
|
ombudsman are disclosed under Subsection (a) may use the |
|
|
information, proceedings, hearing transcripts, or statements only |
|
|
in the performance of a power or duty associated with the member's |
|
|
office. |
|
|
SECTION 2. Section 81.0885, Government Code, as amended by |
|
|
this Act, applies only to a disclosure of information, proceedings, |
|
|
hearing transcripts, and statements presented to the ombudsman for |
|
|
the attorney discipline system of the State Bar of Texas that occurs |
|
|
on or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2021. |
