A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a limitation on the amount of a fee charged by a public |
|
|
institution of higher education for late payment of student housing |
|
|
costs. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter E, Chapter 54, Education Code, is |
|
|
amended by adding Section 54.5042 to read as follows: |
|
|
Sec. 54.5042. LIMITATION ON AMOUNT OF FEE FOR LATE PAYMENT |
|
|
OF STUDENT HOUSING COSTS. The governing board of an institution of |
|
|
higher education may not charge a student a fee for late payment of |
|
|
student housing costs incurred by the student for a semester or term |
|
|
in an amount greater than five percent of the total student housing |
|
|
costs incurred by the student for that semester or term. |
|
|
SECTION 2. This Act applies beginning with fees for late |
|
|
payment of student housing costs charged for the 2021 fall |
|
|
semester. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2021. |
