A BILL TO BE ENTITLED
|

|
AN ACT
|
|
|
relating to the issuance of a certificate of convenience and |
|
|
necessity for providing electric service in the extraterritorial |
|
|
jurisdiction of a municipality. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 37.056, Utilities Code, is amended by |
|
|
adding Subsection (g-1) to read as follows: |
|
|
(g-1) In an application proceeding for a municipally owned |
|
|
utility seeking a certificate for a new transmission line or |
|
|
facility in the extraterritorial jurisdiction of the municipality, |
|
|
an electric utility may file a motion requesting that the |
|
|
commission consider granting the certificate to the electric |
|
|
utility. Subsections (e) and (f) do not apply to the new |
|
|
transmission facility or line if a motion is filed under this |
|
|
subsection. |

|
SECTION 2. This Act takes effect September 1, 2021. |
