A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the participation of distributed energy resources in |
|
the ERCOT market. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter Z, Chapter 39, Utilities Code, is |
|
amended by adding Section 39.9165 to read as follows: |
|
Sec. 39.9165. PARTICIPATION OF DISTRIBUTED ENERGY |
|
RESOURCES IN THE MARKET. (a) In this section, "distributed energy |
|
resource" means a generation resource that: |
|
(1) provides generation, storage, or both; |
|
(2) is interconnected at or below 60 kilovolts; and |
|
(3) operates in parallel with the distribution system. |
|
(b) The commission by rule shall allow a person who owns or |
|
operates a distributed energy resource with an installed capacity |
|
of 10 megawatts or less to participate in the ancillary and |
|
wholesale energy market in the ERCOT power region. |
|
(c) In allowing for the participation of a person who owns |
|
or operates a distributed energy resource to participate under |
|
Subsection (b), the commission shall adopt interconnection, |
|
registration, qualification, telemetry, data submission, and |
|
compliance requirements that are less rigorous than requirements |
|
for a generation resource that is not a distributed energy |
|
resource. |
|
(d) The commission shall allow a person to aggregate |
|
distributed energy resources that are geographically linked to an |
|
electric bus or node for participation as an aggregated resource in |
|
the ancillary and wholesale energy market in the ERCOT power |
|
region. |
|
SECTION 2. The Public Utility Commission of Texas shall |
|
adopt the rules required by Section 39.9165, Utilities Code, as |
|
added by this Act, not later than September 1, 2023. |
|
SECTION 3. This Act takes effect September 1, 2021. |
