A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to good cause for revoking the tenure of or otherwise |
|
|
disciplining a faculty member of a public institution of higher |
|
|
education in this state. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 51.942, Education Code, is amended by |
|
|
adding Subsection (c-1) to read as follows: |
|
|
(c-1) For purposes of Subsection (c)(5), good cause for |
|
|
revoking the tenure of or otherwise disciplining a faculty member |
|
|
includes the faculty member's initiation of a civil suit against a |
|
|
student enrolled at the institution, regardless of whether the |
|
|
claim is subsequently litigated or dismissed. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2021. |
