A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to requiring witnesses to sign an instrument conveying |
|
|
real property interest. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 5, Property Code, is |
|
|
amended by adding Section 5.0025 to read as follows: |
|
|
Sec. 5.0025. WITNESSES TO CONVEYANCE REQUIRED. An |
|
|
instrument intended as a conveyance of real property or an interest |
|
|
in real property is invalid unless the instrument is attested by two |
|
|
or more credible witnesses who are at least 14 years of age and who |
|
|
subscribe their names to the instrument in their own handwriting in |
|
|
the grantor's presence. |
|
|
SECTION 2. Section 5.0025, Property Code, as added by this |
|
|
Act, applies only to an instrument executed on or after the |
|
|
effective date of this Act. An instrument executed before the |
|
|
effective date of this Act is governed by the law as it existed |
|
|
immediately before the effective date of this Act, and that law is |
|
|
continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2021. |
