A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to qualifications for sheriffs in certain counties. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1701.302, Occupations Code, is amended |
|
|
by amending Subsection (a) and adding Subsection (a-1) to read as |
|
|
follows: |
|
|
(a) Except as provided by Subsection (a-1), an [An] officer, |
|
|
including a sheriff, elected under the Texas Constitution or a |
|
|
statute or appointed to fill a vacancy in an elective office must |
|
|
obtain a license from the commission not later than [the second |
|
|
anniversary of] the date the officer takes office. |
|
|
(a-1) An officer described in Subsection (a) must obtain a |
|
|
license from the commission not later than the second anniversary |
|
|
of the date the officer takes office if: |
|
|
(1) the officer serves a county with fewer than 50,000 |
|
|
people; or |
|
|
(2) the commissioner's court of the county served by |
|
|
the officer votes unanimously to waive the requirement of |
|
|
Subsection (a). |
|
|
SECTION 2. An officer subject to Subsection (a), Section |
|
|
1701.302, Occupations Code, as amended by this Act, who holds |
|
|
office on the effective date of this Act must obtain a license from |
|
|
the Texas Commission on Law Enforcement by September 1, 2022. |
|
|
SECTION 3. This Act takes effect September 1, 2021. |
