A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a study on the safety of Texas swim schools. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. DEFINITIONS. In this Act: |
|
(1) "Commission" means the Texas Health and Human |
|
Services Commission. |
|
(1) "Swim School" means a business that provides swim |
|
instruction and employs at least three individuals on a full or |
|
part-time basis whose responsibilities include providing in water |
|
swimming instructions to students. |
|
(2) "Student" means a child who is six years of age or |
|
younger and receives instruction at a Swim School. |
|
SECTION 2. STUDY REGARDING SWIM SCHOOL SAFETY. |
|
(a) The Commission shall conduct a study to assess the current |
|
safety of Swim Schools in the state of Texas. |
|
(b) In conducting the study, the Commission shall consider: |
|
(1) The frequency of which an incident involving |
|
serious injury or death to a Student occurs at Texas Swim Schools; |
|
(2) current safety measures deployed by operators of |
|
Texas Swim Schools; |
|
(3) any other issues that the Commission determines |
|
are relevant to assessing the current safety of Texas Swim schools. |
|
SECTION 3. REPORT TO LEGISLATURE. Not later than December |
|
2, 2022, the Commission shall submit a report to each member of the |
|
Legislature that includes the results of the study conducted under |
|
Section 2 of this Act and any recommendations of the Commission |
|
related to the study. |
|
SECTION 4. EXPIRATION. This Act expires September 1, 2023. |
|
SECTION 5. EFFECTIVE DATE. This Act takes effect |
|
immediately if it receives a vote of two thirds of all the members |
|
elected to each house, as provided by Section 39, Article III, Texas |
|
Constitution. If this Act does not receive the vote necessary for |
|
immediate effect, this Act takes effect September 1, 2021. |
