No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to define the term “exculpatory results.” The bill's definition would include “DNA test results that indicate a match” between an unidentified profile on an evidentiary sample and another individual's DNA profile stored in the national DNA database maintained by the FBI or the state DNA database maintained by DPS, or a profile otherwise in the possession of law enforcement.
Based on the analysis of the Office of Court Administration and Department of Public Safety, it is assumed that duties and responsibilities associated with implementing the bill could be accomplished utilizing available resources. In addition, no significant fiscal impact to the state court system is anticipated with the implementation of the bill.
