LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

March 16, 2021

TO:
Honorable Philip Cortez, Chair, House Committee on Urban Affairs

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB298 by Zwiener (Relating to regulation of outdoor lighting by certain municipalities; creating a criminal offense.), As Introduced

No fiscal implication to the State is anticipated.

This bill would amend the Local Government Code to provide for the regulation of outdoor lighting by certain municipalities and create a Class C misdemeanor offense for a violation of such regulation.

Local Government Impact

The City of Houston anticipates no fiscal implication to the city. No significant fiscal implication to other units of local government is anticipated.

A Class C misdemeanor is punishable by a fine of not more than $500. In addition to the fine, punishment can include up to 180 days of deferred disposition. Costs associated with enforcement and prosecution could likely be absorbed within existing resources. Revenue gain from fines imposed and collected is not anticipated to have a significant fiscal impact.
