LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

March 17, 2021

TO:
Honorable Briscoe Cain, Chair, House Committee on Elections

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB611 by Swanson (Relating to the assistance of voters; increasing a criminal penalty.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Election Code and the Penal Code to expand the oath a person selected to provide voter assistance must take and to increase the penalty for making a false statement as it relates to that oath from a Class A misdemeanor to a state jail felony if the false statement is made more than three times in connection with a single election.

This analysis assumes that any costs associated with the bill could be absorbed using existing resources and that implementing the provisions of the bill would not result in a significant impact on the demand for state correctional resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
