LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

March 12, 2021

TO:
Honorable Nicole Collier, Chair, House Committee on Criminal Jurisprudence

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB667 by Dutton (Relating to asset forfeiture proceedings under the Code of Criminal Procedure.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to make final conviction a necessary element of forfeiture. The bill would also require a judge to dismiss forfeiture proceedings on proof of dismissal or acquittal of the underlying offense.

Based on the analysis of the Office of Court Administration and of the Department of Public Safety, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
