No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code as it relates to the acquisition of real property by entities with eminent domain authority.

Based on information provided by the Office of Court Administration, the Comptroller of Public Accounts, the General Land Office, the Railroad Commission, the Public Utility Commission, the Parks and Wildlife Department, the Texas A&M University System, the University of Texas System, and the Department of Transportation (TxDOT), the costs associated with the bill could be absorbed using existing resources.

Local Government Impact

According to TxDOT, the bill's provisions may positively impact units of local government by creating a standard and expedited timeline for the appointment of and striking of special commissioners for eminent domain proceedings, which would potentially allow projects to start sooner.
