No significant fiscal implication to the State is anticipated.
The bill would add a new chapter to Civil Practice and Remedies Code and would create authority for a person having legal custody of a minor, who does not have a guardian or guardian ad litem, to settle claims on their behalf.
The bill would require money payable under a settlement agreement to be deposited into a registry of a court and would prevent the withdrawal, removal, pay out, or transfer of money paid to a minor to any person, including the minor, expect in certain circumstances.
Based on analysis of the Department of Family and Protective Services, it is assumed that the costs associated with implementing the provisions of the bill could be absorbed within existing resources.
