LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

March 14, 2021

TO:
Honorable Jeff Leach, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB1078 by Landgraf (Relating to liability arising from farm animal activities.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code to expand some definitions and to limit the liability of any person, including a farm or ranch owner or operator, for property damage or damages arising from the personal injury or death of a participant in certain farm animal activities or livestock shows. The bill would provide exceptions to this liability limitation.

Based on the analysis of the Office of Court Administration and the Department of Agriculture, it is assumed that duties and responsibilities associated with implementing the bill could be accomplished utilizing existing resources. In addition, no significant fiscal impact to the state court system is anticipated with the implementation of the bill.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
