Fiscal Analysis

The bill would amend Chapter 601, Transportation Code to establish the Texas Uninsured Vehicle Program. The bill would direct the Texas Department of Public Safety (DPS) to establish a program in consultation with other law enforcement agencies to use an automatic license plate reader system to identify uninsured vehicles. 

The bill would stipulate how plate data could be used and requires DPS submit an annual report on the administration and results of the program during the previous fiscal year, no later than January 1 of each year. The report must be available on DPS' website and provided to the legislature.

Methodology

The Department of Public Safety (DPS) estimates 24.0 Troopers and 6.0 Administrative Assistants III, as well as 8.0 indirect support staff that includes 5.0 Program Specialists V and 3.0 Criminal Intelligence Analysts III to maintain and manage this program. The Information Technology (IT) Division estimates the need for 2.0 Program Specialists V and 1.0 Database Administrators IV. DPS estimates that the additional workload requirements would cost $15,687,566 for the 2022-23 biennium.

According to the Comptroller of Public Accounts, implementation of the program would have no revenue implications, however, fiscal implications regarding potential increases in revenue from fine remittances for uninsured vehicles as the result of the program cannot be determined.

This analysis assumes the provisions of the bill would not result in a significant impact on state correctional populations or on the demand for state correctional resources.


Technology

DPS estimates in the first year of the program there would be a cost of $135,000 for updating database queries to implement the Texas Uninsured Vehicle Enforcement Program within the existing Texas Law Enforcement Telecommunications System and $43,815 for 345 hours of programming support. The estimated cloud computing cost to the maintain the data is $69,846 in each fiscal year.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
