No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to provide that the state would have 30 days to respond to an application for a writ of habeas filed after the final conviction in a felony case imposing a penalty other than death. Currently, the state must file a response no later than 15 days after receiving a copy of the application from the clerk.
Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.
