No significant fiscal implication to the State is anticipated.
The bill would amend the Utilities Code to permit the substantially prevailing party to recover reasonable attorney's fees, court costs, and other expenses if the substantially prevailing party was represented by an attorney, the party presents claims to the opposing party, and payment for the just amount owed is not tendered before the expiration of the 30th day after the claim is presented.
Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.
