IN RE:	HB1340 by Leach (Relating to the extent of a defendant ’s criminal responsibility for the conduct of a coconspirator in a capital murder case.), Committee Report 1st House, Substituted

The bill would amend the Code of Criminal procedure to allow imposing the death penalty on a defendant convicted of capital murder solely as a coconspirator if: the defendant was a major participant in a conspiracy to commit a felony; and, in attempting to carry out that conspiracy, one of the defendant's coconspirators acts with reckless indifference to human life and commits capital murder in furtherance of the conspiracy.

Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.

This analysis assumes the provisions of the bill addressing felony sanctions for criminal offenses would not result in a significant impact on state correctional agencies.
