March 31, 2021

TO:
Honorable Nicole Collier, Chair, House Committee on Criminal Jurisprudence

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB1403 by Johnson, Ann (Relating to the imposition of consecutive sentences for certain offenses arising out of the same criminal episode.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code to allow a court to impose consecutive sentences for certain offenses arising from the same criminal episode.

Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill. Based on information provided by the Texas Department of Criminal Justice, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be accomplished utilizing existing resources.

This analysis assumes the provisions of the bill addressing sentencing for criminal offenses would not result in a significant impact on state correctional agencies.

Local Government Impact

According to the Texas Association of District and County Attorneys, no fiscal impact is anticipated.
