HB1491 by Dean (Relating to the liability of a rural or community hospital for a health care liability claim.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies to provide that, in an action on a health care liability claim where final judgment is rendered against a rural or community hospital, civil liability for noneconomic damages cannot exceed $100,000. The bill would provide that, in a wrongful death or survival action on a health care liability claim where final judgment is rendered against a rural or community hospital, civil liability cannot exceed $100,000.  

Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.
