Under the provisions of the bill, a person who, as outlined in the bill, unlawfully transfers a firearm, purchases or attempts to purchase a firearm, or knowingly makes a false or misleading statement related to the criminal background check would commit a third degree felony.
The Office of Court Administration and Department of Public Safety indicate the modifications outlined in the bill's provisions would not result in a significant fiscal impact. The Comptroller of Public Accounts does not anticipate any administrative costs and indicates that the amounts and timing of any revenue from court costs and fines that would result from the creation of a new offense cannot be determined. This analysis assumes implementing the provisions of the bill addressing felony sanctions would not result in a significant impact on the demand for state correctional resources.
