No fiscal implication to the State is anticipated.
The bill would amend the Local Government Code to prohibit counties and
municipalities from adopting regulations requiring an owner of a vacant
residential building, when repairing damage to the building, to improve the
building to a condition that is better than would have been legally acceptable
before the damage occurred. The bill would also allow owners of vacant residential buildings to file suit against counties
and municipalities related to the prohibition.
Local Government Impact
According to the Texas Association of Counties, the bill's provisions could have an indeterminate fiscal impact to counties resulting from litigation over regulation of vacant residential buildings.
The fiscal implications of the bill to municipalities cannot be determined at this time.
