No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to require applicants for construction, operation, or maintenance of a facility to store, process, or dispose of medical waste to notify certain elected officials as defined in the bill of this application not later than 30 days after filing for the application and requires the Texas Commission on Environmental Quality (TCEQ) to reject applications submitted by a person that has not complied with this notification requirement. In addition, the bill would prevent the TCEQ from issuing a permit for a new medical waste facility or expansion of an existing facility within 500 feet of certain locations as defined in the bill. Based on the analysis of the TCEQ and the Health and Human Services Commission, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be absorbed with existing resources.
