LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

May 18, 2021

TO:
Honorable Charles Perry, Chair, Senate Committee on Water, Agriculture & Rural Affairs

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB2148 by Stephenson (relating to notification by the Department of State Health Services and the Texas Commission on Environmental Quality of incidents of Naegleria fowleri.), Committee Report 2nd House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Water Code to require the Department of State Health Services (DSHS) to notify the Texas Commission on Environmental Quality (TCEQ) when it detects or becomes aware of human infection caused by the presence of Naegleria fowleri amoeba in certain water sources as defined in the bill. The bill requires TCEQ to subsequently notify the appropriate public water systems after receiving such a notice from DSHS. Based on the analysis of the TCEQ and DSHS, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be absorbed with existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
