IN RE:	HB2308 by Gates (Relating to procedures in certain suits affecting the parent-child relationship filed by the Department of Family and Protective Services.), As Engrossed

The bill would amend Family Code to require the Department of Family and Protective Services (DFPS) to provide additional information in an affidavit when taking possession of a child as well as require a court to make certain findings before issuing a temporary order for conservatorship, restraining order, or allowing a governmental entity to take possession of the child. In addition, the bill would allow the alleged perpetrator to agree to an order to leave the residence of the child and allow a court to terminate the order on a finding the order is not needed and is in the best interest of the child.

Based on analysis of DFPS and the Office of Court Administration, it is assumed that the costs associated with implementing the provisions of the bill could be absorbed within existing resources.
