No significant fiscal implication to the State is anticipated.

The bill would amend the Local Government Code as it relates to the regulation of certain BYOB establishments. The bill would require the commissioners court of a county to require the owner or operator of a BYOB establishment in the unincorporated area of the county to file a notice of operation with the county judge. The bill would prohibit a BYOB establishment from operating in an unincorporated area of a county unless the owner or operator of the establishment files the notice as required. The bill would allow certain entities to inspect a BYOB establishment and would create a criminal penalty for certain violations related to an inspection or notice of operation.

According to the Office of Court Administration, no significant fiscal impact to the state court system is anticipated.

Local Government Impact

An offense under the provisions of the bill would be a misdemeanor punishable by a fine of not more than $5,000, confinement in county jail for not more than 90 days, or both. Costs associated with enforcement and prosecution could likely be absorbed within existing resources. Revenue gain from fines imposed and collected is not anticipated to have a significant fiscal impact.

Taylor County anticipates that the bill would have no significant fiscal impact on the county provided the health inspector duties included in the bill can be delegated to a commissioners' court appointee or the Sheriff's Office. No other significant fiscal implication is anticipated for other units of local government.
