LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

April 12, 2021

TO:
Honorable Tracy O. King, Chair, House Committee on Natural Resources

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB2863 by Kuempel (Relating to the storage and recovery of water in a portion of the Edwards Aquifer.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would add the Alliance Regional Water Authority, the Canyon Regional Water Authority, or a municipally owned utility owned by the City of Buda, the City of Kyle, or the City of San Marcos as eligible entities for exceptions to current prohibitions of injection into or through the Edwards Aquifer and states that a political subdivision would be eligible for the exception to prohibited injection into or through the Edwards Aquifer if it has a water right or contract for use of injected state water that does not prohibit use of the water in an aquifer storage and recovery project.

Based on information provided by TCEQ, this analysis assume that duties and responsibilities associated with implementing the provisions of the bill could be absorbed with existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
