LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

April 5, 2021

TO:
Honorable Tracy O. King, Chair, House Committee on Natural Resources

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB2990 by Morales Shaw (Relating to a requirement to make certain environmental and water use permit applications available online.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Water Code to require applicants for water quality, industrial and hazardous waste, municipal solid waste, and underground injection control permits to post a copy of their application, including any revisions or supplements, on a publicly accessible website and provide the website address to the agency. The applicant would be required to maintain the posting until final action by the agency. The bill would also require water rights permit applicants for new appropriations of water to post a copy of their application, map and supporting materials, including any application revisions or supplements, on a publicly accessible website. The applicant would be required to maintain the posting until final action by the agency.

Based on the analysis of the Texas Commission on Environmental Quality, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be absorbed with existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
