LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

April 5, 2021

TO:
Honorable Terry Canales, Chair, House Committee on Transportation

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB3399 by Ortega (Relating to the authority of the Texas Department of Transportation to provide road services on federal military property.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to authorize the Texas Department of Transportation (TxDOT) to enter into an agreement with the United States Department of Defense or another federal entity to allow TxDOT to assist in the provision of road services for military installations. The bill would stipulate that state funds may not be used to provide services under the agreement and would prohibit entering into an agreement if payment for the services provided would be made from federal highway funding provided to the State.

Based on the information provided by TxDOT, it is assumed any duties associated with implementing the provisions of the bill could be absorbed within the agency's existing resources and any costs for providing road services would be covered by payments received by TxDOT from the United States Department of Defense or another federal entity under an agreement authorized by the bill

Local Government Impact

No fiscal implication to units of local government is anticipated.
