LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

April 24, 2021

TO:
Honorable Brooks Landgraf, Chair, House Committee on Environmental Regulation

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB3477 by Rose (Relating to the termination of corporate privileges for certain business entities under enforcement action for a violation of environmental laws.), As Introduced

No significant fiscal implication to the State is anticipated.

This bill would amend the Business Organizations Code and Water Code to authorize the Secretary of State (SOS) to terminate a filing entity's existence if the Texas Commission on Environmental Quality (TCEQ) has issued an order of termination for the entity based on a determination by TCEQ that the entity is responsible for an environmental disaster in the State. The bill also authorizes the SOS to reinstate a filing entity that has been involuntarily terminated if TCEQ issues an order of reinstatement for the entity. Based on the analysis of the TCEQ and SOS, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be absorbed with existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
