LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

May 27, 2021

TO:
Honorable Dan Patrick, Lieutenant Governor, Senate

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB68 by Miles (Relating to a duty for peace officers to intervene and make a report when a peace officer uses excessive force.), As Passed 2nd House

No significant fiscal implication to the State is anticipated.

This bill would amend various codes as they relate to a duty for peace officers to intervene and make a report when a peace officer uses excessive force. Under the provisions of the bill, certain reporting and duty to intervene requirements would be clarified and the criminal offense of interference with public duties would be modified amended to provide an additional defense to prosecution.

It is assumed the costs associated with implementing the bill's provisions relating to a duty for peace officers to intervene and make a report when a peace officer uses excessive force could be absorbed using existing resources. This analysis assumes implementing the provisions of the bill would not result in a significant impact on state correctional populations or on the demand for state correctional resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
