April 22, 2021

TO:
Honorable Donna Campbell, Chair, Senate Committee on Veteran Affairs & Border Security

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB149 by Powell (relating to the prosecution of the offense of operation of unmanned aircraft over certain facilities.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to expand the offense of operating an unmanned aircraft over a correctional, detention, or critical infrastructure facility to include a public or private airport depicted in any aeronautical chart published by the Federal Aviation Administration and a military installation owned or operated by or for the federal government, the state, or another governmental entity. The bill would not change the current criminal penalties for the offense, which is punishable as a Class B misdemeanor, except it is a Class A misdemeanor if the actor has been previously convicted of the offense or of operating an unmanned aircraft over a sports venue, in violation of Government Code Section 423.0046.

Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.

Local Government Impact

The Texas Association of Counties does not anticipate a significant fiscal impact to counties.
