SB270 by Perry (Relating to civil liability of a nursing facility resident's responsible payor for misappropriation of the resident's funds.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would allow nursing facilities to file an action against a resident's responsible payor if the payor is found to have misappropriated the resident's resources to a degree that the resident is unable to pay for their care at the facility. Nursing facilities would not be allowed to recover a total amount, including damages and attorney's fees, that exceeds the amount the payor has misappropriated from the resident.

The Office of Court Administration anticipates no significant fiscal impact to the state court system.

The Health and Human Services Commission anticipates no significant fiscal impact with implementing the provisions of the bill.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
