No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code relating to entity names that might falsely imply governmental affiliation with a governmental unit. The bill provides that in addition to granting injunctive relief, a court may award monetary damages to the governmental unit in certain circumstances.
The bill would also authorize the Secretary of State (SOS) to determine if an entity name falsely implies an affiliation with a governmental entity and would authorize the Office of the Attorney General (OAG) to bring a civil action relating to this determination.
According to the SOS, the bill would not have a significant fiscal impact on the agency.
According to the Office of Court Administration, no significant fiscal impact to the state court system is anticipated.
According to the OAG, the bill would have no significant fiscal impact; any additional legal work could be reasonably absorbed with current resources.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
