Honorable Bryan Hughes, Chair, Senate Committee on State Affairs
FROM:
Jerry McGinty, Director, Legislative Budget Board
IN RE:
SB275 by Hinojosa (Relating to the use of an entity name that falsely implies governmental affiliation.), As Introduced
No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code relating to entity names that might falsely imply governmental affiliation with a governmental unit. The bill provides that in addition to granting injunctive relief, a court may award monetary damages to the governmental unit in certain circumstances.
According to the Secretary of State, because the bill does not present any new filing requirements or require action by the agency, there is no fiscal impact on the agency.
According to the Office of Court Administration, no significant fiscal impact to the state court system is anticipated.
Local Government Impact
No significant fiscal implication to units of local government is anticipated.
