LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

May 8, 2021

TO:
Honorable Stephanie Klick, Chair, House Committee on Public Health

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB442 by Hughes (Relating to local school health advisory councils and health education provided by public schools, including requirements regarding human sexuality instruction.), As Engrossed

No significant fiscal implication to the State is anticipated.

It is assumed that the costs associated with the bill's provisions relating to local school health advisory councils and health education provided by school districts, including requirements regarding human sexuality instruction, could be absorbed using existing resources.

Local Government Impact

The bill's provisions would require school districts and charter schools to implement a process for adopting curriculum materials for human sexuality instruction that is substantially similar to the process used by the State Board of Education in adopting its list of instructional materials.  Additionally, schools would be required to post on their website all curriculum materials used in human sexuality instruction and to provide by mail or email to a parent of each student a copy of all curriculum materials used in human sexuality instruction upon request.
