No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code to provide that a person may recover reasonable attorney's fees from another person (rather than an individual or corporation) for certain claims. The bill would provide that a claimant or defendant may recover reasonable attorney's fees from a person if the claimant or defendant prevails in an action for an oral or written contract. The bill would require that, to recover attorney's fees, the claimant or defendant must be represented by an attorney and must present the claim to the opposing party.
Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.
