No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to provide that the Texas Judicial Council, in consultation with the Department of State Health Services, must by rule develop and implement a voluntary certification process by which a county clerk may be certified to issue a marriage license to applicants through remote technology. The bill would require the procedures to ensure sufficient verification of each applicant's age and identity to prevent fraud. The Judicial Council would adopt the rules no later than January 1, 2022.

The bill would amend the Family Code to provide that, in a county in which the county clerk has been certified by the Texas Judicial Council to issue a marriage license through the use of remote technology, a person who applies for a marriage license through the use of remote technology is considered to have appeared before the court and the clerk may issue a marriage license through the use of the remote technology only in accordance with the procedures adopted by the Judicial Council.

Based on the analysis of the Office of Court Administration and Department of State Health Services, it is assumed that duties and responsibilities associated with implementing the bill could be accomplished utilizing available resources. In addition, no significant fiscal impact to the state court system is anticipated with the implementation of the bill.
