No significant fiscal implication to the State is anticipated.

The bill would amend Health and Safety Code Chapter 773 to require the Health and Human Services Commission to adopt rules authorizing the emergency transfer of a dialysis patient from the patient's location directly to an outpatient end stage renal disease facility during a declared disaster. The bill would amend Utilities Code Chapter 38 to require the Public Utility Commission of Texas to require an electric utility to give end stage renal disease facilities the same priority that it gives to a hospital in the utility's emergency operation plan for restoring power after an extended power outage. The bill would also amend Water Code Chapter 13 to require an emergency preparedness plan submitted under the chapter to prioritize water restoration to an end stage renal disease facility.

The Health and Human Services Commission and the Public Utility Commission of Texas indicate any cost to implement provisions of the bill would be minimal and could be absorbed within available resources.
