CRIMINAL JUSTICE IMPACT STATEMENT

87TH LEGISLATIVE REGULAR SESSION

March 17, 2021

TO:
Honorable James White, Chair, House Committee on Homeland Security & Public Safety

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB496 by Wu (Relating to a peace officer's duty to display and provide the officer's name and identification number; creating a criminal offense.), As Introduced

The provisions of the bill addressed by this analysis would amend the Code of Criminal Procedure as it relates to a peace officer's duty to display and provide certain identification information.  Under the provisions of the bill, an officer's failure to display their name and badge number or provide their first name, last name, and badge number upon request would be punishable as a Class C misdemeanor.

A Class C Misdemeanor is punishable by a fine not to exceed $500 (up to 180 days of deferred disposition and no confinement).

This analysis assumes the provisions of the bill would not result in a significant impact on the demand for state correctional resources.
