LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

87TH LEGISLATIVE REGULAR SESSION
Revision 1

April 16, 2021

TO:
Honorable Garnet Coleman, Chair, House Committee on County Affairs

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB775 by Walle (Relating to the adoption of noise regulations by certain counties; creating a criminal offense; authorizing fees.), Committee Report 1st House, Substituted

The provisions of the bill addressed by this analysis would amend the Local Government Code as it relates to the miscellaneous regulatory authority of counties. Under the provisions of the bill, a county with a certain population size would be allowed to regulate certain noises above certain levels, and a violation of such an order would be punishable as a Class C misdemeanor.

A Class C misdemeanor is punishable by a fine not to exceed $500 (up to 180 days of deferred disposition and no confinement). This analysis assumes implementing the provisions of the bill would not result in a significant impact on the demand for state correctional resources.
