HB1097 by Lozano (Relating to the processing and sale of kratom and kratom products; providing civil penalties; creating a criminal offense.), Committee Report 1st House, Substituted

The provisions of the bill addressed by this analysis would amend the Health and Safety Code as it relates to food and drug health regulations. Under the provisions of the bill, to distribute, sell, or expose for sale a kratom product to a minor would be punishable as a Class C misdemeanor.
 
A Class C misdemeanor is punishable by a fine not to exceed $500 (up to 180 days of deferred disposition and no confinement). This analysis assumes implementing the provisions of the bill would not result in a significant impact on the demand for state correctional resources.
