CRIMINAL JUSTICE IMPACT STATEMENT

87TH LEGISLATIVE REGULAR SESSION

April 6, 2021

TO:
Honorable Stephanie Klick, Chair, House Committee on Public Health

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB3218 by Schaefer (Relating to the regulation of abortion, including information regarding perinatal palliative care and prohibiting discriminatory abortions; authorizing disciplinary action; providing a civil remedy; creating a criminal offense.), As Introduced

The provisions of the bill addressed by this analysis would amend various codes as they relate to the regulation of abortion.  Under the provisions of the bill, a person who violates the abortion regulations as defined in the bill would commit a Class A misdemeanor.

A Class A misdemeanor is punishable by a fine of not more than $4,000, confinement in a county jail for a term not to exceed one year, or both. This analysis assumes implementing the provisions of the bill would not result in a significant impact on the demand for state correctional resources.
