HB4214 by Allen (Relating to the eligibility for an occupational license by certain former inmates and the practice of certain occupations by an inmate of the Texas Department of Criminal Justice.), Committee Report 1st House, Substituted

The provisions of the bill addressed by this analysis would amend the Occupations Code as it relates to licensing and regulation. Under the provisions of the bill, the conditions under which occupational experience gained while imprisoned would be acceptable for purposes of licensing would be amended, the Commission of Licensing and Regulation would be allowed to adopt rules for the issuance of certain licenses to individuals within Texas Department of Criminal Justice state correctional institutions, and these individuals would be excepted from certain regulatory statutes in the performance of certain types of work.

This analysis assumes implementing the provisions of the bill would not result in a significant impact on the demand for state correctional resources. The bill does not expressly create a felony offense, increase the punishment for an existing misdemeanor to that of a felony, increase the punishment for an existing felony offense or category of felony level offenses, or change the eligibility of a person for felony community supervision, parole, or mandatory supervision.
