LEGISLATIVE BUDGET BOARD
Austin, Texas

CRIMINAL JUSTICE IMPACT STATEMENT

87TH LEGISLATIVE REGULAR SESSION

March 30, 2021

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB36 by Zaffirini (Relating to the offense of hazing.), As Introduced

The provisions of the bill addressed by this analysis would amend the Education Code as it relates to the reporting of hazing incidents. Under existing statute, the knowing failure to report a hazing incident is punishable as a Class B misdemeanor. Under the provisions of the bill, the list of individuals to whom a report of hazing could be given would be modified and certain medical professionals would now be required to report suspected hazing activities to law enforcement.

A Class B misdemeanor is punishable by confinement in county jail for a term not to exceed 180 days and in addition to confinement, an optional fine not to exceed $2,000.

This analysis assumes implementing the provisions of the bill would not result in a significant impact on the demand for state correctional resources.
