LEGISLATIVE BUDGET BOARD

CRIMINAL JUSTICE IMPACT STATEMENT

87TH LEGISLATIVE REGULAR SESSION

April 30, 2021

TO:
Honorable Briscoe Cain, Chair, House Committee on Elections

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB1112 by Bettencourt (Relating to requirements for an early voting ballot voted by mail; creating a criminal offense.), As Engrossed

The provisions of the bill addressed by this analysis would amend the Election Code as it relates to requirements for an early voting ballot voted by mail. Under the provisions of the bill, certain election officials would commit a Class A misdemeanor if they suspend the requirements outlined in the bill.

A Class A misdemeanor is punishable by a fine of not more than $4,000, confinement in a county jail for a term not to exceed one year, or both. This analysis assumes implementing the provisions of the bill would not result in a significant impact on the demand for state correctional resources.
